1. Ownership of rights
All rights, including copyright, in this website are owned by or licensed to Bringy Furniture. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.
2. Accuracy of content
We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been described accurately. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. Any dimensions, colouring or finishes given about the goods are for guidance and are approximate only.
3. Damage to your computer
We cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
Some of our ranges are available from stock but many of our ranges are made specially to order for you by the manufacturers. Consequently, these ranges have an increased lead-time before we will be in a position to deliver your goods to you.
5. Product Specification
5.1 All of our furniture, whether made from wood, leather, upholstered fabric or other material is made from good quality products. When furniture is made from wood, each piece of furniture is unique, with its own grain characteristics and hence appearance between each piece may vary. Grain characteristics like knots, open grain, medullary rays are all naturally occurring features and will not be considered grounds for rejection by a customer. 5.2 If you are buying wooden products from us, you will find that the timber will mellow with age and exposure to sunlight. This is quite normal and, after a little while, the mellowing process is complete and goes no further. Any new piece added to the range will mellow in the same way when first received and will catch up with previously bought furniture. Some of our ranges have varying degrees of distressing generally applied. This is very much intended and makes each piece totally individual and unique. Small amounts of filler can occasionally be used on oak and pine furniture. This is a standard manufacturing technique and usual industry practice.
5.3 Our leather products are made from natural leather and accordingly each item may vary slightly in shade and tone between one piece and another. This is a quite natural feature of leather products. All of our leather products are made from either corrected grain or bonded leather. Leathers of these types have the distinct advantage of having consistent grain characteristics (as opposed to un-corrected grain which is more expensive, is often very variable in grain appearance and can suffer from weak spots caused by abrasions on the hide of the animal from rubbing against trees, barbed wire etc.).
5.4 We endeavour to display as accurately as possible the colours of our products that appear on the website. However, we cannot guarantee the complete accuracy of products in the pictures or photographs that are shown. Many conditions such as computer monitor settings and camera lighting can affect the colouring of items in a picture. Similarly, in your home, the appearance of products can vary, dependent on the level of natural light and how you illuminate your room. Natural wood products also have a range of variance in appearance due to the grain characteristics of each piece. This means that each piece of furniture is unique but means we cannot guarantee the exact uniformity of every piece. Leather items can also vary slightly in tone and shade between one piece and another, due to once again each item being made from a natural product. Similarly, upholstered pieces can have an appearance of shading variations due to the nap of the fabric working in different directions. Ranges that have had a painted finish applied to them are normally extremely consistent and there should be no concerns regarding colour variations between pieces.
6. Product Dimensions
All dimensions on our web site are those supplied by the manufacturers. They are accurate but small variance can occur. Customers should note that if a piece of furniture is being fitted in an alcove or rebated area, then due to variance in plaster work, skirting boards etc., the width and depth dimensions in these areas are likely to be variable. We suggest that customers check dimensions at a number of different points and allow a little space for such anomalies.
7. Product Assembly
7.1 Most of our products are sold fully assembled. Certain pieces will need a minimal amount of assembly (e.g. fitting handles, upstands etc.) but as part of our standard service we can happily do all this for you, including taking away any packaging.
7.2 If we are delivering something such as a large wardrobe, then normally this is not delivered fully assembled. We will happily offer to assemble large items for you in the room of your choice as part of our standard service UNLESS we are delivering goods to a destination where we use third party carriers when a surcharge for this assembly service will be applied. Many customers undertake the task of assembling items themselves, but if you are concerned about this in any way, please feel free to ‘phone us and we can discuss it with you.
7.3 Similarly, beds, due to their size, come in sections and will therefore require assembly, either by you or by us. Please note that beds are the one item for which we charge a fee for assembly. Please also note that once assembled, beds occasionally may need re-tightening after a few weeks, once they have settled in to the home environment. This stops them squeaking! Even if we have assembled the bed for you, you will need to undertake any subsequent re-tightening.
8.1 The price payable for goods is as indicated on our website, and is believed to be correct. All prices are inclusive of VAT at the current rate. If we have made a genuine mistake in our pricing, we reserve the right to not process any order at the quoted price.
8.2 We offer a Price Promise that is discretionary, not contractual and is subject to the conditions set out below and in the Price Promise section of our website.
The conditions of our Price Promise are:
- The item offered is exactly the same as the one we sell and is publicly offered to all customers on the same terms, in a shop, on a website (but matching the prices in any related shop) or available over the telephone.
- Clearance items are excluded from our price promise.
- Items are being delivered and assembled or installed to the same standard and cost as our delivery service.
- Our Price Promise applies up to 7 days after you place your order with us.
- We reserve the right to cancel any order in the event that you have requested that we match the price of a competitor under the terms of our Price Promise, and we consider that it would be uneconomical for us to do so.
9. Payment terms
9.1 We will take payment in our shop for any orders placed (goods ordered in person in the shop or over the ‘phone) by credit card, debit card or cash. It is also possible to pay by cheque or by bank transfer, but we will not complete your order until any monies paid by these methods have cleared. We accept no liability if a delivery is delayed because you did not give us the correct payment details. We will not complete any deliveries of goods until any outstanding monies have been paid and cleared. Normally, customers settle any outstanding balances on money owed, either over the ‘phone or visit us in the shop, whatever suits you best. This is normally done a day or two before we make our pre-arranged delivery to you.
9.2 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
10. Delivery charges
Delivery charges vary according to the transaction value of your order and whereabouts in Essex or other areas of the UK we are delivering your goods to. Goods are delivered free of charge in the county of Essex if you spend over £500.
Regrettably, certain post codes in remote areas are not possible for us to deliver to via our third party contractors.
11. Delivery Location
11.1 If you live abroad, or in a part of the UK that we do not deliver directly to, we can deliver your furniture to a UK based shipping agent on the same basis as if we were delivering to a private address, on the understanding that delivery to this address fulfils our obligation and contract to you, and that you accept responsibility for onward delivery to your own home.
11.2 Please note that deliveries to third parties such as shipping agents will require payment in full by bank transfer or cheque. These funds will need to be cleared before completing our delivery.
11.3 We will deliver the goods to the address you specify for delivery in your order. It is important that this address is complete and accurate. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence), including an instruction for us to leave the goods in an unsecured location.
12. Delivery Lead Time
12.1 Delivery lead times, dates and times are not guaranteed, and therefore time is not of the essence.
12.2 Any changes made to the content of your order will have an impact on the delivery date. We may therefore be unable to deliver your goods on your originally indicated delivery date should changes occur. If you have amended your order in any way, we can happily discuss with you the consequences of any amendments.
13. Delivery Method & Access
13.1 You are responsible for providing a safe means of access from the public highway to the place of delivery. If the delivery team considers that access from the public highway is unsafe, then we will not deliver the goods until access is provided.
13.2 Due to the complexities of approach and access, we can only guarantee delivery to the front door. Delivery to any other point is at the discretion of the driver and by invitation of the customer.
13.3 If you are unable, for whatever reason to take delivery of your goods on the confirmed delivery date arranged or we are unable to deliver the goods due to there being no safe means of access to the place of delivery or you are not available at the pre-arranged time and day of delivery, we will subsequently contact you to make new arrangements. We reserve the right however to levy an additional fee to cover any additional costs incurred by us.
13.4 If our carriers accidently damage goods in the course of delivery, our liability for that damage is limited to the repair, replacement or refund of the goods, or the value thereof.
14. Cancellation by us
14.1 We reserve the right not to process your order if:
14.1.1 We have insufficient stock to deliver the goods you have ordered and having been advised of any lead applicable times you are not prepared to wait;
14.1.2 We do not deliver to your geographic area; or
14.1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
14.1.4 You have requested that we match the price of a competitor under the terms of our Price Promise, and we consider that it would be uneconomical for us to do so.
14.2 If we do not process your order for the above reasons, we will notify you by ‘phone or e-mail and will re-credit to your account any sum deducted by us from your credit/debit card or paid by bank transfer as soon as possible, but in any event within 14 days.
15. Cancellation by you
15.1 Should you wish to cancel your order, and therefore your contract with us, you must notify us in writing by any durable medium (for example letter sent by post or e-mail) and within seven days of placing the order and only if the goods have not already been delivered.
15.2 We may make a deduction from your refund for any loss in the value of the goods supplied if the loss is the result of unnecessary handling by you (for example using the goods prior to cancellation).
16.1 If we deliver incorrect or damaged goods, or in the event that you discover a defect in the goods for which you require a remedy, please contact us as soon as you can and we will be happy to help and to arrange a repair or an exchange, as appropriate.
16.2 If an item is being exchanged, you are very welcome to use the faulty item in the meantime, until we can re-deliver a replacement item. Hopefully, by adopting this approach, any inconvenience to you is kept to an absolute minimum. All that we would ask is that you use the faulty item with care and consideration as it will be returned to our supplier after we have supplied a replacement.
16.3 We will not be liable for any damage or loss resulting from repairs attempted by you or any third parties.
16.4 Refunds will only be paid by the method and to any card that may have been used to place the order.
17.1 We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) do or fail to do, or is due to events which are beyond our reasonable control.
17.2 Furthermore, we do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.
17.3 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site for ultimate delivery to countries outside of the UK. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
17.4 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. You have certain rights as a consumer including legal rights (e.g. under the Sale of Goods Act 1979 (as amended)) relating to faulty and/or mis-described goods.
18. Changes to legal notices
18.1 We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible. Your continued use of our website is subject to the terms and conditions in force at the time of your use.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
21. Third party rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
22. Law, jurisdiction and language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. We control and operate this website from our offices in England. Accordingly, the laws of England and Wales govern claims relating to, including the use of this website and the materials contained therein. If you choose to access this website from outside England and Wales, you do so on your own initiative and you hereby agree that in the event of a dispute between ourselves and you, the laws of England and Wales will apply at all times.
